Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by Progressive Transportation Services LLC ("we," "us," or "our"), operated by AbeMedia LLC, you ("you" or "Customer") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Services

Progressive Transportation Services LLC provides local and regional transportation services including:

• Local and long-distance moving
• Furniture and appliance delivery
• Hauling and junk removal
• Commercial and residential freight transport
• Same-day and scheduled delivery services

Services may be requested directly or through third-party platforms such as Thumbtack, Housecall Pro, or other service marketplaces.

3. Service Requests and Scheduling

• Service requests submitted through our platform or third-party platforms are not binding until confirmed by our team.
• We reserve the right to decline any service request at our discretion.
• Scheduling is subject to availability. We will make reasonable efforts to accommodate your preferred dates and times.
• Automated systems may be used to provide initial responses to service inquiries. Final scheduling and service details are confirmed by our team.

4. Pricing and Payment

• Service rates are quoted on a per-job or hourly basis and communicated prior to service commencement.
• Quoted prices are estimates unless otherwise stated as fixed-price agreements.
• Additional charges may apply for services beyond the original scope, including but not limited to: excessive stairs, long carry distances, additional stops, or specialty item handling.
• Payment is due upon completion of services unless alternative arrangements are made in advance.
• We accept payment via cash, credit/debit card, and digital payment methods.

5. Cancellation and Rescheduling

• Cancellations made at least 24 hours before the scheduled service incur no charge.
• Cancellations made less than 24 hours before the scheduled service may incur a cancellation fee.
• We reserve the right to cancel or reschedule services due to weather, safety concerns, vehicle availability, or other circumstances beyond our control.

6. Customer Responsibilities

You agree to:

• Provide accurate and complete information regarding the scope of services needed.
• Ensure clear and safe access to pickup and delivery locations.
• Disclose any items requiring special handling, including but not limited to: hazardous materials, fragile items, or items exceeding standard weight or dimensions.
• Be present or have an authorized representative present at the time of service.

7. Liability and Limitations

• We exercise reasonable care in handling your belongings during transportation and delivery.
• Our liability for loss or damage to items during transport is limited to the lesser of the item's depreciated value or $500 per item, unless additional coverage is purchased in advance.
• We are not liable for damage to items improperly packed by the customer.
• We are not liable for pre-existing damage, normal wear and tear, or damage caused by factors beyond our control.
• In no event shall our total liability exceed the total amount paid for the specific service giving rise to the claim.

8. Prohibited Items

We do not transport the following:

• Hazardous materials, explosives, or flammable substances
• Illegal or controlled substances
• Live animals
• Perishable goods (unless specifically arranged)
• Items of extraordinary value without prior disclosure and agreement

9. Intellectual Property

All content, branding, logos, and materials associated with Progressive Transportation Services LLC and AbeMedia LLC are our property or used under license. You may not reproduce, distribute, or use our intellectual property without written permission.

10. Third-Party Platforms

When services are initiated through third-party platforms (such as Thumbtack), the terms and policies of those platforms also apply. In the event of a conflict between these Terms and a third-party platform's terms, the more protective provision shall apply.

11. Privacy

Your use of our services is also governed by our Privacy Policy, available at our website. By using our services, you consent to the collection and use of information as described therein.

12. Dispute Resolution

• Any disputes arising from or related to these Terms or our services shall first be addressed through good-faith negotiation.
• If negotiation fails, disputes shall be resolved through binding arbitration in Maricopa County, Arizona, in accordance with the rules of the American Arbitration Association.
• You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted with an updated effective date. Continued use of our services after modifications constitutes acceptance of the revised Terms.
